Photo Release Agreement - version 1.1

 The following agreement is with the individual prior to having a portfolio taken by Majid Sadri. It covers the use of the portfolio, and outlines Majid Sadri's limitations and responsibilities when offering the service. TERMS AND CONDITIONS for modeling and work with Majid Sadri

The submission of a portfolio does not guarantee any work for the model. Majid Sadri conducts a private service and portfolios are granted on a case-by-case basis. Majid Sadri reserves the right to withdraw or withhold services to any person by notice before the photo shoot.

Portfolio applicants for artistic nude photo shoots must be at least eighteen (18) years of age with photo identification submitted to Majid Sadri with the exclusion of glamour shots, or family portraits, parental consent must be in writing and given to Majid Sadri by the guardian or parent.

Portfolio applicants must have their own e-mail address.

A model must manage their own portfolio, and must communicate directly when responding to enquiries without the use of a third party such as an agent. Majid Sadri does not accept portfolios that are managed by third parties, with the exception of parents in the case of minors, or where special dispensation has been granted due to the requirement of a 'facilitator', such as in situations where there is a lack of email access. The roll of a facilitator should be a messenger and not a negotiating party. No third party 'agents', 'managers', 'minders', etc. are to enter the negotiations as a middleman. Majid Sadri reserves the right to remove portfolios that are found to be in breach of this requirement.

Models who have completed a photo shoot by Majid Sadri may be registered with Model, Acting or Promotions Agencies but those representatives are NOT to be involved in either negotiations or demands for commission regarding work initiated by contacts through Majid Sadri’s web site.

Majid Sadri will not permit portfolio links to pornography, in particular "pay sites" or "sales sites".

By doing photo shoots with Majid Sadri, you are indicating you have the right to publish the images on his site for the purpose of self promotion, Majid Sadri is permitted to use all images on his portfolio as purpose of self promotion.

Majid Sadri has exclusive rights to publish your image(s) on digimaj.net web site for purposes of promotion of himself.

You grant Majid Sadri permission to edit sections of your portfolio, as needed, to suit these terms and conditions, and/or to suit our image content requirements.

Your use of Majid Sadri’s services is mainly to build up your new portfolio for free and Majid Sadri can use all those images on his site and portfolio as return only for self promotion purpose.

You permit Majid Sadri to promote you for any modeling site.

This agreement made on the --/--/20-- is entered into between _____________________ (“model”) and Majid Sadri (“photographer”) for usage of photographs of the model taken by the photographer on or about --/--/20

In return for the consideration described below, the model hereby gives the photographer and those acting with the photographer’s permission the irrevocable right to use and/or copyright images of the model, in all forms and media and in all manners, including alterations and composite representations, for any lawful purpose without restriction (except as expressly provided below) and without further compensation to the model.

The model further releases the photographer, and those acting with the photographer’s permission, from any claims for remuneration or other compensation associated with any form of damage, whether foreseeable or not, sustained or suffered by the model (or any other person), associated with the commercial or artistic use of these images unless it can be shown that such reproduction was maliciously caused, produced and published for the sole purpose of subjecting the model to conspicuous ridicule, hatred, contempt or indignity.

The model waives any right to inspect or approve the finished photograph(s) or image(s), or any copy that may be used in connection with the photograph(s) or image(s), or the use to which it is applied.

The model acknowledges that at all times the photographer retains the copyright subsisting in the images and is the owner of all negatives or original digital files from which the said images are directly or indirectly derived for self promotion only.

The photographer, and those acting with the photographer’s permission, agree not to use the images of the model in whole or in part to sell or promote sex, or to be used in conjunction with pornography, violence or illegal/illicit activities.

In exchange for modeling services, the model will receive the following compensation from the photographer:

One CD copy of all original photographs taken by Majid Sadri under the terms of this contract as well as 10 images of all original would be edited for better presentation which could be use on models portfolio.

The irrevocable right to use and reproduce said photographs without alteration, for lawful personal and non-commercial purposes at the model’s expense and without compensation to the photographer.

The irrevocable right to use and reproduce said photographs without alteration, as part of a modeling portfolio or for other personal publicity purposes, at the model’s expense and without further compensation to the photographer, provided that the photographer’s name and copyright of the image is expressly acknowledged, unless it can be shown that such usage or reproduction was for the purpose of subjecting the photographer to conspicuous ridicule, hatred, contempt or indignity.

The model acknowledges being at least 18 years of age and legally, mentally and otherwise fully competent to enter into this contract in his or her own name.
